Parliamentary privilege was created to protect the powers of Barons, against arbitrary interference by Kings, stopping Parliament carrying out the will of the barons who elected it. All other humans were no threat - they were either possessions to be used or vermin to be exterminated, they did not have any vote nor any other powers.
That function of privilege is now redundant. In New Zealand, no king has any real power to stop parliament. And, since the peaceful world revolution at the end of WW2. by which the United Nations Charter created a whole new human rights-based world order, changing nations in international law from fiefdoms defined by conquerors, to geographic regions where the inhabitants had the right to govern themselves, our parliament is supposed to represent the collective people, not barons. The concept of protecting governments from the very people whose will they are supposed to carry out, is an outrageous travesty.
Other jurisdictions have gone further and literally invented kings - Presidents and upper houses — to blatantly and openly prevent the will and interests of the people being carried out.
Since the expansion of suffrage to ordinary people, immunity has been used to protect the power of the political Barons and the economic barons that decide who people elect, against the public whose will they are theoretically supposed to be carrying out.
It has been expanded from discussions in Parliament to blanket immunity of the actions of all politicians before and after election, all state employees including judiciary, and all local body actors, in relation to any exercise of their powers.
The most important aspect of that immunity is the immunity from any duty to disclose. Resulting in the massive secrecy we are controlled by.
That duty is part of the fiduciary duty the law imposes on any person who has power over the affairs of another person. Without it, society would not function.
Instead of our elected parliaments being automatically bound by duty to us, to protect and advance us and our country — privilege, an instrument of independence in a world of total oppression, was expanded into immunity, the instrument of oppression.
As far as I can see, the expansion was created by the House of Lords specifically to retain power by means of bribery, threats and influence, at the same time suffrage was expanded.
It seems a simple matter to pass a simple piece of legislation removing that immunity completely, whereupon the ordinary law will impose fiduciary duty, along with all other applicable laws which exist to protect society from grifters.
People need to be re-educated that removal of immunity will in fact protect good faith actors, as the law largely does now in the private sector, and would do better if not vitiated by endemic corruption from police to courts to lowly state and local body officials.
